Medical Marijuana Laws and Employment
Because marijuana is legal as a prescription drug in about 29 states, there are some issues concerning whether or not this drug is an issue for employment when it shows up positive on a drug test. It varies across the states and even in certain industries of work. There are state laws which regard the need for medical marijuana to be a qualification for disability and must abide by disability accommodation laws. These states are Rhode Island, New York, and Massachusetts. Though, the latter does not always imply that it is a disability accommodation which is reserved for New York employees across the state. If the employee, prospective or employed, is a cardholder then they must speak with their employer on the matter in order to diffuse any confusion.
